Conforming to Article 13 of Legislative Decree 30 June 2003, n. 196 "Code regarding the protection of personal data" (henceforth noted as "Code") and Article 13 of Regulation (EU) 2016/679, containing provisions to protect individuals with regards to the processing of personal data and the free circulation of such data (henceforth noted as"GDPR"), we hereby provide you with the information concerning the processing of your personal data.

Holder of the processing of personal data
1. Your personal data will be processed, according to the purposes as better identified in following paragraph 3 "Purpose of the processing of personal data", by the following entity as independent data controllers:

Categories of personal data processed
1. Personal data provided voluntarily
  Personal data supplied directly by yourselves will be processed as part of the processing of personal data. Personal data means "any information concerning an identified or identifiable natural person ("concerned"); an identifiable natural person can be identified, either directly or indirectly, with particular reference to an identifier such as a name, an identification number, location data, an online ID or one or more characteristic elements of his physical identity, physiological, genetic, psychological, economic, cultural or social "and the images (Article 4 paragraph 1 No. 1 of the GDPR).
2. Personal data of third parties provided voluntarily
  Kindly note that any material in relation to personal data and contact details of any other person in the context of services provided by Gottardo S.r.l is deemed that you are the data controller of such personal data of the aforementioned data subjects.
  Therefore, you, as the owner of such personal and contact data are to ensure that the personal and contact details of the aforementioned data subjects have been collected and communicated in accordance with the provisions in force on data protection.
  To this end, you commit yourself to inform the aforementioned data subjects whose personal data is collected and communicated in relation to the methods and purposes of the processing, in accordance to article 13 of the Code and article 13 of the GDPR. The personal data of the aforementioned parties will be communicated for the sole purpose of providing, management services by Gottardo S.r.l.
Purposes of processing personal data
Your personal data will be processed, with your explicit consent if and when necessary, by Gottardo S.r.l. as independent Data Controller and better described below.
1. Purpose of the processing of personal data by Gottardo S.r.l.
  Gottardo S.r.l. will process your personal data for:
  (i) the provision of services, such as the management of orders and related payments, any complaints and communications with you;
  (ii) marketing purposes in the broader sense, ie. to send you, by any means of communication (fax, e-mail, sms, mms, paper mail, phone calls with operator or other), advertising and informative material, promotional or otherwise, commercial solicitation related to services, products or discounts related to Gottardo Srl products and services, this in accordance to article 130 of the Code as well as to elaborate studies, research and market statistics;
  (iii) profiling purposes regarding individual customers or groups of customers to allow the assessment, analysis or forecasting of personal preferences regarding the value and type of services purchased, the methods and types of shipments, reliability, behavior , to the destination addresses of your shipments, to the services that most often requires in order to offer you additional services, products or discounts on the products supplied by Gottardo Srl.
Legal basis for the processing of personal data
The legal basis for processing of personal data as outlined in paragraph 3.1 (i) is the contract of which you are party in order to allow the execution and management of the services by Gottardo S.r.l.
The provision of your personal data and/or the recipient of the shipment for the aforementioned purpose is optional, however, failure to provide your personal data and/or that of the person receiving the shipment will make it impossible to perform and manage the services by Gottardo Srl.
The legal basis of processing such data for the purposes as outlined in paragraph 3.1 (ii) and 3.1 (iii) with your specific consent.
The provision of your personal data for the aforementioned purpose is optional and failure to provide information will result in only the impossibility for Gottardo S.r.l. to send advertising and promotional messages, to carry out market research and to proceed with the aforementioned profiling. The implementation and management of the Services of Gottardo S.r.l. remains unaffected.
Furthermore by giving your consent you authorize Gottardo S.r.l. to pursue the purposes, respectively, referred to in paragraph 3.1 (ii) and 3.1 (iii) above, you are free to, at any time to revoke the consent and/or to oppose the processing of data for the aforementioned purposes. This by sending written communication to this effect to the addresses better specified in paragraph 10 "Contacts for exercising the rights of the interested party and for further information" below.
When exercising your right of opposition for marketing purposes, it will cover all the electronic, automated and traditional contact modes, or you can exercise your right to oppose only to just some contact channels. For example, by contacting the Data Controller in writing to the addresses specified in paragraph 10 "Contacts for the exercise of rights of the interested party and for further information" that follows, you may object only to sending promotional communications via automated methods. (ie contact by e-mail, sms, mms, etc.) and therefore consent only to receiving communications using traditional methods (ie paper mail or telephone contact with an operator).
Following receipt of request for revocation and/or opposition, Gottardo S.r.l. will promptly proceed to the removal and cancellation of your personal data from its’ databases and inform, where possible, for the same purposes of cancellation any third parties to whom the data have been communicated.
Methods of processing personal data
Your personal data will be processed using manual, computerized and telephonic tools, as well as on paper.
The personal data you provide will not be subjected to automated decision-making processes, with the exception of the profiling referred to in the above paragraph 3.1 (iii).
Recipients of personal data
Your personal data - will not be disclosed by Gottardo S.r.l. – but may be communicated to:
(i) employees, agents or collaborators of Gottardo S.r.l. that, are located on the territory of the European Union;
(ii) data subjects which, Gottardo S.r.l. will make use of for profiling and marketing activities that are located in the European Union;
(iii) third-party companies with which, from time to time form commercial partnership agreements and/or initiatives, campaigns and common projects will be developed that are located throughout the European Union;
(iv) data subjects who provide assistance and advice to Gottardo S.r.l. in accounting, administrative, legal, tax and financial matters that are on the territory of the European Union;
(v) data subjects, bodies or authorities to whom the communication of your personal data is compulsory in order to conform to the provisions of law or orders by authorities;
The data subjects or the categories of data subjects to which your personal data will be communicated by Gottardo S.r.l. will, be responsible for the data and will be treated as independent data controllers.

Transfer of non-EU personal data
Your personal data and those of other subjects will not be transferred outside the European Union by Gottardo S.r.l.
Retention times of personal data
As per application of the principle of proportionality, we inform that:
Gottardo S.r.l. for the purposes referred to in paragraph 3.1 (i) (execution and management of the Gottardo Srl Services), will keep your personal data for the time necessary for the execution and management of the related services, without prejudice to any specific obligations of the law on conservation accounting documentation;
Gottardo S.r.l. for the purposes referred to in paragraph 3.1 (ii) (marketing) will retain your personal data for a period not exceeding twenty-four months from registration, save the actual transformation in an anonymous form. Will not permit, access directly/indirectly or by linking other databases , Gottardo S.r.l. for the purposes referred to in paragraph 3.1 (iii) (profiling) will retain your personal data for a period not exceeding twelve months from their registration. Save the actual transformation in an anonymous form that will not allow, the identification of the interested parties; directly/ indirectly or by linking other databases.
Exercise of rights by the interested party
Conforming to article 7 of the Code and also to articles 13, paragraph 2, letters (b) and (d) and from 15 to 22 of the GDPR, we inform you that:
a) You have the right to ask the Data Controllers to access your personal data, correct or cancel them or limit their processing or to oppose their treatment, or to withdraw consent, in addition to right to data portability;
b) You have the right to lodge a complaint with the Guarantor, following the procedures and instructions published on the official website of the Guarantor on www.garanteprivacy.it;
c) any corrections or cancellations or limitations on the processing carried out upon your request - unless this proves impossible or involves a disproportionate effort - will be communicated by the Data Controllers to each of the recipients to whom your Personal Data have been transmitted. The Data Controllers will be able to communicate these recipients if they expressly request it.
Your requests for the exercise of your rights must be addressed in writing to the Data Controllers at the addresses indicated in the below paragraph 10 "Contacts for exercising the rights of the interested party and for further information".
The exercise of rights is not subject to any form constraint and is free of charge.
For the sake of completeness, the text of article 7 of the Code, is reproduced below:
Art. 7. Right to access personal data and other rights
1. The interested party has the right to obtain confirmation of the existence or not of personal data concerning him/her, even if not yet registered, and their communication in intelligible form.
2. The interested party has the right to obtain the information:
a) source of the origin of personal data;
b) the purposes and methods of the processing;
c) the logic applied in case of treatment carried out with the aid of electronic instruments;
d) the identification details of the owner, of the managers and of the designated representative conforming to article 5, paragraph 2;
e) the data subjects or categories of data subjects to whom the personal data may be communicated or who may become aware of it in their capacity as designated representative in the territory of the State, managers or agents.
3. The interested party has the right to obtain:
a) updating, rectification or, when interested, integration of data;
b) cancellation, transformation into anonymous form or blocking of data processed unlawfully, including data whose retention is unnecessary for the purposes for which the data were collected or subsequently processed;
c) the confirmation that the operations referred to in letters a) and b) have been brought to the attention, also with regards to their content, of those to whom the data has been communicated or disseminated, except in the case where such fulfillment proves impossible or involves a use of means manifestly disproportionate to the protected right.
4. The interested party has the right to object, in whole or in part:
a) for legitimate reasons, to the processing of personal data concerning hi/ her, even though they are relevant to the purpose of the collection;
b) to the processing of personal data concerning him for the purpose of sending advertising or direct sales material or for carrying out market research or commercial communication.
